Terms of Service

1. What FlirtMaster is

FlirtMaster is a SaaS service that imports your messaging chats, builds persistent memory per contact, and lets you consult Alma, an AI counsellor, about that content. FlirtMaster is the dating edition of Memchats: the same service, focused on dating, with tools to improve your own profile. The legal entity behind it is Codelabs Studio, S.L. (Tax ID B88708797), registered at Paseo Federico García Lorca 6, 3.º E, 29130 Alhaurín de la Torre (Málaga, Spain), reachable at hola@memchats.com.

2. What we promise

• That the service works as described on the pricing page for your tier
• That the main servers and database run on European infrastructure (Hetzner, Germany). Some of the processors listed in the privacy policy process data outside the EU, or without an EU-jurisdiction guarantee, under the safeguards stated there
• That we never use your messages to train AI models
• That you can cancel anytime with one click
• That you can export your data as structured JSON at any time

3. What we ask of you

• Only import chats you were part of. Do not upload third-party chats where you were not present (e.g. downloads of other people's chats). FlirtMaster is personal use, analogous to a diary. The only other content you may upload is what section 5 allows in Dating: profiles a dating app showed you as a user.
• Do not abuse the service (spam, scraping, attempts to compromise infrastructure, fraud)
• Do not use FlirtMaster to stalk, harass, or manipulate another person
• Do not upload content that is illegal in your jurisdiction
• Pay your subscription on time if you have a paid plan

4. Your responsibility over third-party data

When you upload a chat with María, you take on legal compliance responsibility for that data:

• FlirtMaster stores the conversation under your account only, never shares it with other accounts and never uses it to train models
• If María requests deletion of her data directly from FlirtMaster, we will delete it within 30 days
• You guarantee that you have the right to import the chat (e.g. you were a participant)
• FlirtMaster is not liable for claims arising from misuse on your part

5. Dating and FlirtMaster: adults only

Dating, and FlirtMaster as a whole, are only for people aged 18 or over. Before using them for the first time you must declare it; if the declaration is false, we may close the account. When you upload content about other people in Dating you undertake that:

• Its origin is lawful: they are profiles a dating app showed you as a user, or conversations you took part in. You do not obtain them by scraping, fake accounts, or other people's screenshots
• They are adults. If a profile looks like it belongs to a minor, you do not upload it
• You do not add special categories of data (health, sexual orientation, religion, political opinions…) beyond what the person published in their own profile
• You do not expose them: you do not publish, forward, or re-upload their photos or details outside your account, nor use them to identify or locate the person outside the dating app
• You delete the person from your account if they ask you to, and you accept that we delete them if they ask us

Your own photos (FlirtMaster). You may only upload photos of yourself, and only if you are 18 or over. Generated photos must look like you: improved, never another person. Use them in line with the rules of each dating app on photos; they carry a metadata label stating they are made with AI. The analysis of your profile and bio is a suggestion, not a guarantee of results.

6. Intellectual property

• Your messages: yours. FlirtMaster only processes them to serve you
• Generated structured memory (traits, timeline, etc.): derived, co-generated output. You own it; FlirtMaster holds a license to process it while your account exists
• FlirtMaster's software: ours
• Alma's answers (written by an LLM): yours to use; they do not constitute formal legal/tax/medical advice

7. Payments and subscriptions

• We process payments via Stripe. We never have access to your card
• Subscriptions renew automatically at the end of each period
• You can cancel at any time from your dashboard; you keep access until the end of the paid period
• Full refund within the first 14 days, no questions asked
• After 14 days we do not issue partial refunds (LLM costs have already been incurred)

Right of withdrawal. If you buy as a consumer in the EU, you have 14 calendar days to withdraw without giving a reason. FlirtMaster is digital content delivered immediately: by subscribing and starting to use it you expressly ask us to begin at once and acknowledge that, once fully performed, you lose that right under article 103.m of the Spanish consumer protection act. Regardless of that, and beyond what the law requires of us, we refund you in full if you ask within the first 14 days at hola@memchats.com.

• Founding Members: €7/month price locked-in for life for the first 1000. Not transferable. If you cancel and come back, you do not recover the Founding price

8. Important disclaimers

Alma, the FlirtMaster counsellor, is an AI system. Her answers do not constitute formal legal, tax, medical, or psychological advice. She is a support tool. For critical decisions (legal, medical, financial) always consult a qualified, licensed human professional.

Specifically regarding Alma when the conversation has legal consequences (Spanish law): she provides guidance based on current Spanish legislation, but does not replace a licensed lawyer.

9. Service availability

We make reasonable efforts to keep the service available 24/7. But we are a project under active development: maintenance, failures, or degradations can occur.

• Availability target: best-effort 99% monthly, with no service credits
• Enterprise: a service level with credits can be agreed in the Enterprise contract itself. It is not offered by default under these terms and it is not in force until that contract is signed.

10. Limitation of liability

To the extent permitted by law, FlirtMaster is not liable for indirect damages, lost profits, or lost opportunities arising from use of the service. Total maximum liability is limited to the amount you paid in the 12 months prior to the incident.

11. Termination

You can cancel whenever you want. FlirtMaster may suspend or close your account if:

• You materially breach these terms
• You commit fraud (repeated chargebacks, false identity)
• You put other users or the infrastructure at risk

Before closing an account for a breach we will notify you 7 days in advance, except in serious cases.

12. Governing law and jurisdiction

These terms are governed by Spanish law. For disputes, the competent courts are those of Madrid (Spain), unless your country's consumer protection law establishes otherwise.

13. Changes to these terms

If we make material changes to these terms, we will notify you by email 30 days in advance. If you do not accept the new terms, you may cancel and export your data before they take effect.
